Terms of Service

These terms govern your use of Equata. By creating an account or using the service, you agree to them. If you are accepting on behalf of a school or district, you confirm you have authority to do so.
Accounts & Credentials
Teachers and other account holders are responsible for maintaining the confidentiality of their login credentials and for all activity that occurs under their account. Do not share passwords, and notify us promptly if you believe an account has been accessed without authorization.
Teachers who create student logins are responsible for distributing those credentials appropriately within their classroom.
Acceptable Use
You agree not to:
- use the service for anything unlawful, harassing, or harmful to students;
- attempt to access accounts, classrooms, or data that are not yours;
- probe, scan, disrupt, or overload the service or its infrastructure;
- reverse engineer, scrape, or resell the service without written permission;
- upload content that infringes others' rights or is inappropriate for a classroom.
Subscription & Billing Terms
Some features are offered on a paid subscription. Free trials, where offered, convert to a paid plan when the trial ends, and standard fees apply from that point unless the subscription is cancelled beforehand. Subscriptions renew automatically for the same term until cancelled.
Fees are billed in advance and, except where required by law, are non-refundable for partial periods. We may change pricing with notice before the change applies to your next renewal. You are responsible for any applicable taxes.
Account Termination
You may cancel your account at any time; access continues through the end of the paid period. We may suspend or terminate an account that violates these terms, creates risk for other users, or fails to pay applicable fees. After termination we may delete account and classroom data in accordance with our Privacy Policy.
Intellectual Property
Equata and its content, puzzles, and branding remain our property. You retain rights to content you create in the app, and you grant us the limited license needed to host and display it within the service.
Service Availability
The service is provided "as is" and "as available." We do not warrant that it will be uninterrupted, error-free, or that puzzle content will suit every curriculum.
Limitation of Liability
To the maximum extent permitted by law, Equata and its team will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose.
Changes to These Terms
We may update these terms as the service changes. Continued use after an update means you accept the revised terms.
